1. General

These Terms and Conditions (“Terms”) govern your use of the Fusion Pacifico website (fusionpacifico.com) and all related services provided by Fusion Pacifico SRL, a company registered in Costa Rica. By accessing or using our services, you agree to be bound by these Terms.

2. Service Description

Fusion Pacifico operates as a real estate brokerage and listing platform specializing in Costa Rica's Pacific Coast. We connect property owners (sellers and landlords) with prospective buyers and tenants. Our services include property listing, marketing, and brokerage facilitation.

3. Property Listings & Submissions

• By submitting a property listing through our platform, you represent and warrant that you are the lawful owner of the property or are duly authorized to list it on behalf of the owner.
• Submission as Agreement: Each property submission constitutes a binding agreement between the submitting party and Fusion Pacifico SRL to list and market the property under the terms described herein.
• Commission: Fusion Pacifico SRL shall collect a commission of five percent (5%) of the final sale or transaction price upon the successful closing of any deal facilitated through our platform. This commission is due and payable at the time of closing. For rental transactions, the commission is equivalent to one month's rent.
• All listing information provided must be accurate and complete. Fusion Pacifico reserves the right to remove or modify listings that contain inaccurate, misleading, or incomplete information.

4. Media & Content License

By submitting photographs, videos, descriptions, floor plans, or any other materials (“Content”) to Fusion Pacifico, you grant Fusion Pacifico SRL a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, display, distribute, and sublicense such Content for the purposes of:

• Promoting and marketing the submitted property on our website, social media channels, and partner platforms.
• Advertising Fusion Pacifico's services and portfolio.
• Creating derivative works such as virtual tours, brochures, and promotional materials.

You confirm that you own or have obtained all necessary rights, licenses, and permissions for the Content you submit.

5. User Obligations

• You agree not to submit false, fraudulent, or misleading information.
• You must not use our platform for any unlawful purpose.
• You are responsible for maintaining the confidentiality of any account credentials.
• You agree not to scrape, reproduce, or redistribute content from our website without written consent.

6. Limitation of Liability

Fusion Pacifico SRL acts as an intermediary and does not guarantee the accuracy of property listings, the solvency of parties, or the outcome of any transaction. We are not liable for any direct, indirect, incidental, or consequential damages arising from the use of our services. All property transactions are subject to independent legal review and due diligence by the parties involved.

7. Intellectual Property

All trademarks, logos, brand names, website design, and original content on fusionpacifico.com are the property of Fusion Pacifico SRL and are protected under applicable intellectual property laws. Unauthorized use is strictly prohibited.

8. Termination

Fusion Pacifico reserves the right to suspend or terminate access to our services at any time, with or without cause, and with or without notice. Upon termination, any active listing agreements remain enforceable with respect to commissions owed on pending transactions.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Costa Rica. Any disputes arising under these Terms shall be submitted to the jurisdiction of the courts located in San José, Costa Rica.

10. Changes to These Terms

Fusion Pacifico reserves the right to update these Terms at any time. Material changes will be communicated via the website. Continued use of our services after changes constitutes acceptance of the updated Terms.
